A Little About DWI

Being charged with a Fairfax DWI is a scary experience that requires a lawyer skilled in DWI defense to effectively combat.  Every situation is unique and there is no one size fits all strategy that can be employed to handle a Fairfax DWI.  In Virginia, Driving under the influence (DUI) and Driving while intoxicated (DWI) are charged under Va. Code 18.2-266.  Traditionally, Driving under the influence deals with cases where there is no blood alcohol concentration (BAC).  This could be driving under the influence of drugs or alcohol to the degree that your manner, speech, disposition, general appearance, and muscular movement are affected to the degree to be apparent to common observation.  Driving while intoxicated generally denotes driving with a BAC above a .08 (the legal limit in Virginia).  


First offense DWI and DUI is punishable as class 1 misdemeanors.  This means the maximum punishment is up to 12 months in jail and a fine up to $2500.00.  In addition to these punishments, those convicted of DWI or DUI will be required to complete the Virginia Alcohol Safety Action Program (VASAP) and your license will be suspended for 12 months (with a restricted license routinely granted).  If your case involves an elevated blood alcohol concentration (.15 or above) or is a second offense, these punishments are exacerbated by including mandatory minimum jail time and additional license suspensions.  For a third offense, the punishments are far more severe and could leave you a convicted felon.
